Terms of Service

1. Agreement and eligibility

These Terms of Service ("Terms") are a contract between you and Synerwise LLC. They govern your use of 5D's website, application, subscriptions, and related services (the "Service"). By creating an account, purchasing a subscription, or using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old and legally able to enter a contract. A parent or legal guardian controls each household and is responsible for child profiles. Before information is collected from a child under 13, the parent must receive our parental notice and complete the approved verifiable-consent process.

2. What 5D provides

5D is a parent-directed homeschool planning and learning-support system for Pre-K through grade 12. Depending on the plan and features available, it can organize learning plans and curriculum links, guide daily work, provide Coach and Navigator tools, collect evidence and progress, create parent reports, and support exports.

5D is not a school, accredited program, complete curriculum, teacher, counselor, health-care provider, emergency service, or provider of legal advice. It does not guarantee academic outcomes, legal compliance for a homeschool, accreditation, grade placement, or that a third-party curriculum meets a household's needs. The parent remains responsible for curriculum choices, instruction, supervision, records, safety decisions, and compliance with applicable homeschool law.

3. Accounts and household control

Keep parent credentials secure and give each child only the child sign-in assigned to that child. Tell us promptly about suspected unauthorized access.

The person who creates the household is the initial administrator. The administrator role may be transferred. A household may have no more than seven parent accounts.

The administrator controls parent membership and is the only role that may request whole-household deletion. Other parents receive notice of a deletion request.

You represent that you have authority to add each child, provide information about the child, invite other adults, select curriculum links, and give the consents you submit.

Household members may see information about the children and learning activity in that household. Use the Service only with people you trust.

4. Subscriptions, charges, and renewal

A household subscription is sold by Synerwise LLC. The price, billing interval, trial or promotional terms, taxes, and renewal terms shown at checkout are part of these Terms. Unless checkout clearly says otherwise, a paid subscription automatically renews for the same billing interval until cancelled. By purchasing, you authorize Stripe and 5D to charge the payment method on file for each recurring charge and applicable tax.

Before you complete checkout, 5D will display the amount charged now, the renewal amount or how it may change, the billing interval, the date or method for determining the next charge, and how to cancel. Stripe processes payment information under its terms. 5D receives subscription status and transaction references but does not store full card numbers. Failed or disputed payments may cause limited or read-only access.

5. Cancellation and read-only access

You may cancel renewal through the billing-management link in the parent account or through support@5dlearning.com. Cancellation stops future renewal charges but does not normally reverse a charge already made. Paid features continue through the end of the paid billing period unless a refund, chargeback, legal requirement, or serious misuse requires earlier termination. After paid access ends, the household becomes read-only and may be restored for up to 12 months unless the administrator requests deletion sooner. Cancellation is not deletion.

6. Seven-day money-back guarantee

The separate Seven-Day Money-Back Guarantee is incorporated into these Terms. The guarantee applies strictly once per household. It is a full refund of the qualifying subscription charge when the request is received within seven calendar days after the qualifying subscription starts. Refunds return to the original payment method.

7. Exports, archiving, retention, and deletion

Export. The parent administrator may generate an export of household information. Before whole-household deletion, the administrator must generate and download a recent complete export.

Archive. Archiving removes a child from day-to-day use but keeps the child's educational record with the household while that record is retained. Archiving is not permanent deletion.

Inactive retention. A cancelled or lapsed household that does not request deletion remains read-only for up to 12 months and may receive 60- and 30-day warnings before scheduled deletion.

Requested deletion. The administrator may start whole-household deletion after a complete export. The request has a seven-day cancellation window. If not cancelled, 5D deletes the family record and sends applicable deletion instructions to providers.

Parent rights. A verified parent may separately request access to, correction of, an end to further collection of, or deletion of one child's information as required by law.

8. AI, voice, reports, and safety

The Service uses automated and third-party AI and speech tools. Inputs and outputs may be incomplete, inaccurate, or inappropriate. Review important information before relying on it. Do not use 5D to seek or provide emergency, medical, mental-health, legal, financial, or other professional advice.

5D is not live monitoring or an emergency service. Automated review can miss or misread possible safety concerns. Parents can review reports and completed Coach conversations and remain responsible for supervision and follow-up. If anyone may be in immediate danger, contact emergency services or a trusted adult right away.

9. Your content and our intellectual property

You keep ownership of content you or your household submits, such as notes and work samples. You give 5D a limited, worldwide, non-exclusive license to host, copy, process, display, and transmit that content only as needed to provide, secure, support, and improve the Service for your household, comply with law, and enforce these Terms. This license ends when the content is deleted, except for limited lawful retention and technical backup timing described in the Privacy Policy.

5D and its licensors own the Service, software, designs, documentation, branding, and other materials we provide, excluding your content and third-party materials. Subject to these Terms, we give you a limited, personal, non-transferable, revocable right to use the Service for your household's noncommercial educational purposes.

The Service depends on third-party providers and may link to third-party curriculum or other websites. Their services, availability, content, and privacy practices are outside 5D's control. A link is not an endorsement or affiliation. 5D helps a parent organize links the parent selects.

12. Changes, suspension, and termination

We may change features to maintain, secure, improve, or comply with law. If a change materially reduces a paid Service, we will provide any notice or remedy required by law. We may suspend or terminate access for nonpayment, security risk, illegal conduct, serious or repeated violation of these Terms, or when necessary to protect a child or another person. When practical and lawful, we will give notice and a reasonable opportunity to export household data. Sections that by their nature should continue after termination will survive.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." SYNERWISE LLC DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR AI OUTPUT WILL BE ACCURATE, COMPLETE, UNINTERRUPTED, ERROR-FREE, SECURE, OR SUITABLE FOR A PARTICULAR CHILD OR LEGAL REQUIREMENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO THESE LIMITS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYNERWISE LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR SERVICE INTERRUPTION, ARISING FROM THE SERVICE OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO 5D DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US$100. THESE LIMITS DO NOT APPLY TO LIABILITY THAT LAW DOES NOT ALLOW US TO LIMIT.

15. Your responsibility for claims

To the extent permitted by law, you are responsible for third-party claims and reasonable costs caused by your unlawful use of the Service, your content, or your material breach of these Terms. You do not indemnify 5D for 5D's own unlawful conduct or breach.

16. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules, except that applicable federal law controls and mandatory consumer protections remain available. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by mandatory binding arbitration, and not in a court of law. YOU AGREE TO WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE PROCEEDING. Any court proceeding must be brought in the state courts located in Sheridan County, Wyoming, or the federal court with jurisdiction over that county, and each party consents to that venue.

17. General terms

These Terms, the Privacy Policy, the Parental Notice, the guarantee, and checkout terms are the entire agreement about the Service. A specific checkout or parental-consent term controls only for its subject. If one provision is unenforceable, the rest remain effective, and failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them in a corporate transaction. Electronic notices and signatures satisfy written-notice requirements to the extent permitted by law.
